NEW DELHI: A day when Supreme Court has reserved his judgement on appeals for the decriminalization of Section 377 of IPC, a Woman has moved to the SC seeking some stringent provision against her husband who is trying to force her for “unnatural” oral sex during their four years of marriage.
Therefore Aparna Bhat, the lawyer of the Woman accused him of forcing the woman to perform oral sex on him and also said this was nothing but “sex against the order of nature”, which has been categorized as an offence under section 377. Reacting to this A bench of Justices N V Ramana and M M Shantanagoudar issued notices to the husband.
Later, Justice D Y Chandrachud, who was part of the bench, had observed during hearing that “oral sex” or “butt sex” between both consenting wife and husband could not be categorized as unnatural sex or “sex against the order of nature”.
But this petition has already complicated the issue of decriminalizing section 377. Bhat said, “Her husband was incapable of comprehending her objections. Bhat also reveals that she was compelled to put up with perverted demands and later its turns into threats and physical abuse.
Eventually, the wife had lodged an FIR case against her husband for marital rape and unnatural oral sex. Regarding this when the husband moved for quashing of FIR, the Gujrat HC told that there are no provisions for marital rape under section 375 and also rejected the arguments, which constituted an offence under section 377.
